I have a 42 U.S.C. Sec. 1983 Pro Se lawsuit in the 9th Cir. E.D. Cal. Case number 1:22-cv-01468-ADA-HBK. The argument is simple, my federal rights to not be unlawfully discriminated against, on the basis of religion and disability, have allegedly been violated. Tomas J. Aragon wrote the custom-breaking CDPH health order of 11 AUG 2021 which forced school workers to get COVID tested weekly. However, Mr. Aragon then made exceptions from testing for employees who verified their vaccination status. Persons considered "fully vaccinated" (two weeks after the inoculation/s) were exempt from weekly testing. At the same time, workers who provided proof of SARS-COV-2 spike protein antibodies were explicitly not exempt from testing because they, "[were] still potentially able to spread the illness." His provision in the health order was allegedly against ADAAA of 2008, Title 42, sec. 1, Title 1 because regarding a person’s immune system as impaired is illegal since the actual or perceived limitation was not both transitory and minor, and alleged adverse employment actions followed. (Not the same argument as Dr. Aaron Kheriaty) Due to the alleged unlawful disability discrimination, I was also allegedly; denied a reasonable religious accommodation, coerced and attempted to be coerced of my right to medical information privacy, withheld contractual wages, suffered substantial mental distress, and lost earning capacity.

If anyone here knows a great civil rights attorney, please share with them my story. 42 U.S.C. Sec. 1983 lawsuits can request that attorney fees be awarded to the plaintiff's prevailing attorney.
