Mom sues LAUSD after son was vaccinated without her consent

Los Angeles (July 27, 2022) A California family is fighting back after her child’s school denied any wrongdoing for vaccinating her child without her knowledge or consent at school vaccination clinics, causing him adverse reactions requiring emergency medical care.

With the help of Nicole Pearson, founding partner of the Law Offices of Nicole C. Pearson: FACTS LAW TRUTH JUSTICE, the family is taking legal action against the school and bringing awareness to legislation that will remove parents’ ability to protect their children from bribery, coercion and medical negligence already taking place on California campuses.
“Children in California are under attack. While virulence and mortality of COVID-19 continue to go down and parliaments are vetoing vaccine requirements, California legislators like Senators Wiener and Pan, and Assembly members Akilah Weber, Evan Low, and Buffy Wicks, are doubling down on their COVID-19 abuses,” says Attorney Nicole Pearson. “These lawmakers are pushing for perpetual testing; a compulsory, statewide, digital registry; criminalizing doctors who advocate for individualized care; and emancipating children as young as 12 to make medical decisions without their guardians' knowledge or consent, all under the guise of ‘equity.’”
“Our lawsuits prove, however, that minority and immigrant communities not only do not support these policies, but are getting completely annihilated by them. It has become blatantly aware that equity was never their goal and that pulling children away from their families is,” Pearson continues. “People in California - and around the World - have to wake up and stop these policies from being established in our most vulnerable communities. Where California goes, so does the rest of the country. If California falls, so will the United States. And if the U.S. falls, so will the World.”

Child is 13 years old and attends Barak Obama Preparatory Academy in the Los Angeles Unified School District.
His mother had not vaccinated him on advice from pediatrician due to child’s chronic childhood asthma, bleeding issues, and other health concerns, which had resolved but were uncertain to return.
Child was vaccinated at a vaccination clinic on campus when he and his peers were offered free food (pizza) and a party in exchange for receiving the COVID-19 vaccine.
One of the adults at the clinic – affiliation unknown (school, district, independent medical provider) – requested child’s parent’s signed consent form, which he did not have. Child was told to sign his mother’s name and not tell anyone.
Immediately after the vaccine, child began to experience breathing and bleeding issues, shortness of breath, chronic fatigue, depression, and anxiety, among other things, and is receiving medical treatment.
Neither Barak Obama Global Preparatory Academy nor the Los Angeles Unified School District have responded to child’s claims.
Family is preparing lawsuit.
Pearson’s organization is also fighting to stop Senate Bill 866, which is set to be voted on when CA legislature returns to session August 1. This bill lowers the age of consent to make permanently, potentially life-altering medical decisions to 15 years old. Status of the bill is below:
STATUS AND ANALYSIS OF SENATE BILL 866 (c/o FACTS LAW TRUTH JUSTICE):
SB866 would reduce the age of consent to all vaccines to 15 years old. The bill is illegal because it violates federal law - the National Childhood Vaccine Injury Act of 1986 - in that it (1) circumvents the federal requirement that health care providers provide the legal guardian of a minor certain information and materials prior to the minor receiving a vaccine; (2) undermines the federal government’s goal to expeditiously resolve vaccine injury claims; and (3) cuts off a minor's ability to receive financial assistance from the National Childhood Vaccine Injury Compensation Fund in the event of an injury or adverse reaction. Specifically, a minor cannot file a "petition" (claim) with the Fund and the window to file a petition is 3 years from the date of onset of injuries, and 1 year for countermeasures (e.g. CV19). If a minor never reaches the age of majority (18) during that time and his or her guardian has no idea he or she has received a vaccine or countermeasure, the child will never receive assistance to pay for his or her medical care or support. Similar laws - such as the Minor Consent Act of D.C. - were recently halted based upon this reasoning and we will strike SB866 down using this logic, as well, if it passes.
SB866 was not voted on the Assembly Floor before Summer Break, which commenced July 1 and ends July 31, as many representatives recognized these legal hurdles, and also the severe blow to parental rights and the health and safety of these children that allowing a child to receive a vaccine without his or her parent / guardian would be. That said, we anticipate Senator Wiener is using the break to try and convince his colleagues otherwise and return to the Session full steam ahead with this bill.
Note: there is nothing Senator Wiener can do to this bill to make it legal / comply with federal, or medically or ethically sound.
Despite this, existing injuries and violations of law resulting from wrongful vaccinations of children at school and other locations without their parents’ knowledge or consent; and ongoing efforts by FACTS LAW TRUTH JUSTICE and other advocacy groups to explain this to him, Senator Wiener and his supporters continue to attempt to force this bill through.
